Terms & Conditions

Please read the following Terms & Conditions carefully. By booking the photographer, you agree to the following terms & conditions. It is mutually agreed that the following terms of agreement form an integral part of this contract and cannot be varied in any way by the client(s) unless such conditions are expressly agreed by the photographer in writing in advance of the booking. 


"The photographer" refers to James Lynd, or the appropriate representative carrying out the work of the photoshoot and editing process.


"The client" refers to the individual or group referred to on the initial booking form.  

Payment & Refund Policy

  • Unless otherwise agreed, a 50% deposit is expected to secure your booking. This deposit is non-refundable. This is to ensure that the photographer is compensated for the possibility of missing alternate opportunities should a booking be cancelled for any reason. 

  • If a deposit is not paid, then your booking slot will not be held. The photographer reserves the right to cancel your booking at any time without reason if a deposit has not been paid. ​

  • Unless otherwise agreed, full payment is expected before the photoshoot takes place. This is to ensure the photographer does not have to spend time chasing up payments for work done. No finished work will be provided until full payment is made, regardless of agreed upon deadlines. Payments should be made by electronic transfer unless otherwise agreed. Cheques are not accepted.

  • Any payments will be considered late 30 days from the agreed upon deadline. a 10% charge or the total agreed upon fee will be charged for every 30 days beyond the deadline. 

  • All payment is non-refundable once the photoshoot has taken place. Should there be any issues with the work provided, you should contact me at immediately, and the photographer will be in touch to rectify any issues. 

  • Once a project is completed and signed off, no returns or refunds will be accepted. 

Cancellation Policy 

  • Cancellations by the client must be made as soon as possible. If a cancellation is made more than a week in advance, then any payment made will be refunded, minus the 50% deposit. Any bookings cancelled less than a week before the date of the photoshoot will not be refunded. 

  • Should the photographer need to cancel a booking at any time, then a full refund of any payment made will be provided - this will include the 50% deposit fee. Where possible, a suitable and pre-approved replacement shall be provided at no discount or extra cost. 

​Reshoot & Reschedule Policy 

  • If inclement weather, or other adverse conditions prevent the photoshoot from taking place, the photoshoot will be arranged for an alternative date at no extra fee. 

  • Should circumstances arise during the photoshoot that prevent the photoshoot from being completed successfully within its time-frame, then a reshoot may be arranged at the discretion of the photographer. Depending on circumstances, an excess fee may be added for the cost of the reshoot - for instance if particular materials or props were used that need replacing for a reshoot.

  • Should the client need to reschedule an event in advance, they must inform the photographer in writing as soon as possible. If the booking is reschedules more than a week in advance, the 10% deposit fee will carry over to the rescheduled date. Should the client reschedule with less than a weeks notice, a new non-refundable 10% deposit will need to be made to secure the rescheduled date. 

  • Should the client reschedule more than once, additional fees may be applicable at the photographers discretion. 

  • All reshoots and reschedules are subject to the availability of the photographer.  

Permits & Passes

  • It is the responsibility of the client to arrange any and all necessary passes, permits & permissions necessary for all locations on which the photographer will perform his service. 

  • The photographer is not liable for failure to fulfil their obligations to the client as a result of venue or location restrictions. It is the responsibility of the client to ensure that the necessary permissions are obtained in advance of the booking. 

Health & Safety

  • Any directions issued to clients, their guests or employees during a photographic shoot/event are deemed to be at said persons own risk. The photographer cannot be held responsible for any personal accidents during a photographic shoot. 


  • Copyright of all work is retained with the photographer unless otherwise agreed with the client in advance of the photoshoot taking place. 

  • Images sold are provided on either a personal use, or a commercial use agreement - the use of which will be detailed in the Agreement signed by the Client. 

  • Unless otherwise agreed, images shared on social media for personal use should be suitably credited to the photographer, and where possible watermarks should remain visible. Credit for James Lynd Photography can be provided as @JamesLynd for Twitter and Instagram, or James Lynd Photography on Facebook. Images should remain unedited by the Client, including the use of filters, unless written permission is obtained from the photographer beforehand. If in any doubt over the use of any images, please get in touch to ask for permission. 

  • The photographer reserves the right to use any images they created during the clients photoshoot for advertising, display, publication, portfolio or to offer for sale via stock agencies. Should a photo being used for commercial use (ie advertising, or sales) contain a person, written consent will be obtained from that person before being used.

Creative Licence

  • The Photographer shall be granted full creative licence throughout the project, including choice of location, pose, and editing style. The photographers judgement on the creative process, including photographic style and amount of photos taken, will be deemed correct. Some photographs may not be possible due to weather, location or willingness of the subject, and while the photographer will do their best to fulfil the obligation of their booking, no guarantee is made on the exact nature of the finished product.

  • The final post-production and editing styles of the finished product are left to the discretion of the photographer.   

Exclusive Photographer

  • Unless otherwise agreed, the photographer will be the only photographer & videographer contracted for the specific photoshoot or event. 

  • The photographer reserves the right to ask anyone else present at the event to not take photos and to put their cameras away. This includes the use of professional equipment and phone cameras. 

Original Files and Unedited Images

  • Unless otherwise agreed upon, the original RAW/JPEG files will not be provided to the client. Should the photographer agree to provide RAW files, this will be done so at an additional fee at the photographers discretion. 

  • The photographer reserves the right to withhold photos from the clients photoshoot that the photographer deems unfitting for the project. Photoshoots often result in many duplicate shots and tester photos that the client does not need to see, and it is part of post-process to select out the best photos for the project on behalf of the client. 

  • The client does not have any rights to unedited photos, and is not allowed to share them should the photographer provide any as previews or examples. The client, unless otherwise agreed, is purchasing a finished product of fully edited photos representative of the photographers creative process. 


  • The Photographer only guarantees the photos for any project will be archived for up to 4 weeks after the project has been signed off and work delivered. Once work is delivered, it the responsibility of the client to maintain and backup the data. 



  • The client expressly releases the photographer, his employees and agents from all claims, damages, and liabilities that may result from accidents or incidents that occur during the photo session. This waiver of liability includes waiver of any claim that may be a result of negligence.

  • While all care is taken during every stage of the photographic process, James Lynd Photography will not be held liable to the client for any failure, in whole or in part, to fulfil their obligations of the booking, where failure arises due to circumstances beyond the photographers control, including but not limited to; equipment failure, inclement weather, illness or injury. 

Automatic Sign-Off Period

  • James Lynd Photography works hard to deliver a project to the satisfaction of the Client within a reasonable time, but it is the responsibility of the Client to ensure adequate feedback is given, and appropriate communication provided in order to ensure the completion of a project. 

  • All projects will be automatically signed off 90 days after the last email correspondence received from the client to 

  • The Client will receive an email warning them their project is will be signed off, at which time they will have 24 hours to respond. Failure to respond after that time will result in the project being signed off. 

  • Once the project is automatically signed off after this period, the Client will need to pay a fixed administration fee of £100 to reopen the project. Reopening of the project is subject to the availability of James Lynd Photography, and is ultimately at the Photographer's discretion. 

  • Uncollected physical items such as USB sticks or prints, will only be kept for the duration of this 90 day period. Additional fees will be incurred to reproduce any items sought after the automatic sign-off period, and these fees are not covered in the £100 administration fee. 

Prices & Fees

  • James Lynd Photography reserves the right to change price guidelines at any time. Quotes made at any time are only valid for two weeks after the quote has been made, after which a new quote will need to be obtained. 

  • While fees are bespoke to each client, a price list is available upon request to clarify the costs of your fee. This price list can also be found on the invoice. 

Referral Scheme

  • The Refer A Friend scheme allows the individual who referred the friend to redeem £50 off their next booking, as well as the individual they referred to redeem £50 of their first booking. To do so, the referred individual must present the referral card in order to redeem the £50 off. 

  • The referral card is only valid once and is to be retained by the photographer after use. 

  • Offer is valid only for bookings quoted over £150.

  • Offer cannot be used in conjunction with any other offers, promotions or discounts. 


  • All correspondence regarding our project should be done via email. Where possible, emails receive a response within 24 hours.

  • No guarantee is made that I will respond to other forms of media, such as direct messages on social media, phone calls etc. Direct messages can get obscured quickly, and the photographer is not always available to answer phone calls. Correspondence should be made through the contact form on this website or through email.

  • During your shoot itself, the photographer will be available via text and phone call should you need to get in touch immediately. This is, of course, subject to the service reception of the area.  


  • Should the client be dissatisfied in any way, the complaints should be made in writing to The photographer will aim to respond to any complaints within 5 days of receipt. 

James Lynd Photography reserves the right to amend these Terms & Conditions at any time.
